b. Please read these terms of use carefully before you start to use our site.

c. By using our site, you confirm that you accept these terms of use and agree to keep to them.

d. If you do not agree to these terms of use, you must not use our site.

2. Information about us
Our site at www.therapyfinders.co.uk is owned and operated by us, Therapy Finders Ltd. We are a private limited company incorporated in England and Wales under company number 12666734. Our registered office and main trading address is at Tindal House, Tindal Square, Chelmsford, Essex, CM1 1EH.

3. Changes to these terms

a. We can change these terms of use at any time.

b. Please check these terms of use from time to time to take notice of any changes we make, as these are binding on you.

4. Changes to our site

a. We can update our site, and may change the content, at any time. Any of the content on our site may be out of date at any given time, and we are under no obligation to update it.

b. We do not guarantee that our site, or any content on it, will be complete or accurate.

5. Accessing our site

a. The information on our site is made available free of charge.

b. We do not guarantee that our site, or any content on it, will always be available or will never be interrupted. We may suspend, withdraw, discontinue or change all or any part of our site without notice. We will not be liable to you if our site is ever unavailable for any reason.

c. You are responsible for making all arrangements necessary for you to have access to our site.

d. You are also responsible for making sure that everyone who gets access to our site through your internet connection knows about and will keep to these terms of use.

6. Your account and password

a. If you choose, or you are provided with, a username, password or any other piece of information as part of our security procedures, you must keep that information confidential. You must not reveal it to any third party.

b. We can disable any username or password at any time if, in our reasonable opinion, you have failed to keep to these terms of use.

c. If you think or know that anyone other than you knows your username or password, you must tell us as soon as reasonably possible by sending an email to info@therapyfinders.co.uk.

7. Intellectual property rights

a. We own or hold a licence for all intellectual property rights on our site, and in the content on it. The content is protected by copyright laws and treaties around the world.

b. You can print off one copy, and may download extracts, of any page from our site for your personal use, and you can refer others within your organisation to any content on our site.

c. You must not change the printed or digital copies of any content you have printed off or downloaded, and must not use any illustrations, photographs, video or audio sequences or graphics separately from any accompanying text.

d. You must always acknowledge us (and any identified contributors) as the authors of content on our site.

e. You must not use any part of the content on our site for commercial purposes without first getting approval from us or the organisation/person which gave us permission to use that content.

f. If you print off, copy or download any part of our site in a way that breaks these terms of use, your right to use our site will end immediately and you must return or destroy (as specified by us) any copies you have made of the content.

8. Not relying on information

a. We provide the content on our site for general information only. It is not advice you should rely on. You must get professional or specialist advice before taking, or deliberately not taking, any action on the basis of the content on our site.

b. Although we make reasonable efforts to keep the information on our site up to date, we do not guarantee that the content on our site is accurate, complete or up to date.

9. Limit of our liability

a. Nothing in these terms of use removes or limits our liability for death or personal injury arising from our negligence, fraudulent action or statements, or any other liability that cannot be removed or limited under English law.

b. To the extent allowed by law, we exclude all statements, promises, assurances guarantees and implied terms (including, but not limited to, those shown on websites and in marketing material, adverts, brochures, communications and so on) that may apply to our site or any content on it and are not set out in the contract.

c. We will not be liable to any user for any loss or damage, even if it could have been foreseen, arising in connection with you:

    • using, or not being able to use, our site; or
    • relying on any content on our site

d. If you are a business user, please note that we will not be liable for:

    • loss of profits, sales, business or revenue;
    • business interruption;
    • loss of anticipted savings;
    • loss of business opportunity, goodwill or reputation; or
    • any indirect or consequential loss or damage

e. We have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

f. We will not be liable for any loss or damage caused by a virus, hacking or other technologically harmful event or material that may infect your computer equipment, computer programs or other material due to you using our site, downloading content from it, or following any links to other websites.

g. We are not responsible for the content of any websites and articles linked to our site. We do not approve or endorse any linked websites and will not be liable for any loss or damage that may arise from you using them.

10. Contributing content to our site

a. Any contribution you make to our site must meet the content standards set out in our acceptable use policy.

b. Any content you contribute to our site will be considered as non-confidential and non-proprietary, and we have the right to use, copy, distribute and publish that content for any purpose.

c. We also have the right to reveal your identity to any third party claiming that any content contributed by you breaks their intellectual property rights or their right to privacy.

d. We will not be responsible, or liable to any third party, for any content contributed by you or any other user of our site.

e. The views expressed by other users on our site do not represent our views or values.

11. Viruses

a. We do not guarantee that our site will be secure or free from viruses.

b. You are responsible for making sure your information technology and so on allow you to get access to our site. You should use your own virus-protection software.

c. You must not misuse our site by knowingly introducing viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not try to gain unauthorised access to our site, the server our site is stored on or any server, computer or database connected to our site. You must not attack our site with a denial-of-service (DoS) attack (an attack intended to make a system, service or network unusable by flooding it with traffic or information). Breaking this clause is a criminal offence under the Computer Misuse Act 1990. We would report the matter to the relevant law-enforcement authorities and give them your name and contact details.

If you break this clause you will immediately lose your right to use our site.

12. Modifications, Termination, Interruption and Disruptions to the site

a. You understand, agree and acknowledge that we may modify, suspend, disrupt or discontinue the site, any part of the site or the use of the site, whether to all users/clients/members or to you specifically, at any time with or without notice to you.

b. If TherapyFinders Ltd closes by any means, you agree and acknowledge that we will not be liable to issue any refund to you as a member.  On your next payment date, no moneies will be collected and your subscription will be cancelled.

c. You agree and acknowledge that we will not be liable for any of the aforementioned actions or for any losses or damages that are caused by any of the aforementioned actions.

d. The site depends on various factors such as software, hardware and tools, either our own or those owned and/or operated by our contractors and suppliers. While we make commercially reasonable efforts to ensure the site’s reliability and accessibility, you understand and agree that no platform can be 100% reliable and accessible and so we cannot guarantee that access to the site will be uninterrupted or that it will be accessible, consistent, timely or error-free at all times.

13. Linking to our site

a. You may link to our site in a way that is fair and legal and does not damage our reputation or take advantage of it.

b. You must not establish a link to our site without our permission (which we can withdraw without giving you notice). You can ask for permission by sending an email to info@therapyfinders.co.uk.

c. Any link you make to our site must not suggest that you are associated with us, or that you are approved or endorsed by us if that is not the case. You will only be considered to be associated with us, or approved or endorsed by us, if we have specifically told you so in writing.

d. Our site must not be framed (that is, displayed as part of another web page or browser window) on any other site.

e. The website you are linking our site to must meet the content standards set out in our acceptable use policy.

f. If you want to use content on our site other than that set out above, contact info@therapyfinders.co.uk.

14. Third-party links and resources on our site

a. If our site contains links to other sites and resources provided by third parties, these links are for your information only.

b. We have no control over the contents of linked sites or resources.

15. Members

a. We require every member providing therapist services on the site to be qualified and experienced Practitioners e.g. Counsellor, Psychotherapist, Clinical Psychologist, Psychiatrist or a similar applicable recognized professional certification.

b. Members must have a relevant academic qualification in their field after successfully completing the necessary education, exams, training, and practice requirements as applicable.

c. We currently only accept a Level 4 diploma qualification and above, however, this may be subject to change when we believe it is necessary.

d. By ticking these terms and conditions you agree and acknowledge that as a member you are self-employed and not an employee of TherapyFinders Ltd.

16. Supplying our services

a. The services we provide to you will, in all significant or relevant ways, be in line with, or equivalent to, the description or specification of the services either provided in writing by us or set out on the Join Our Community webpage, as the case may be.

b. We will take reasonable steps to meet any performance dates shown on our site, but those dates are estimates and are not binding on us.

c. We can make any changes to our services if this is necessary to keep to any relevant law or safety requirement, or if the change does not significantly affect the nature or quality of our services. We will give you notice of any change we make.

d. When we have received the member information (your name and contact details, details of your training, qualifications, experience, your areas of counselling or therapy and your fees) and any proof we need (for example, proof of your membership with a professional body, qualifications and insurance cover), we can refuse your request to be listed on our site if:

    • we cannot verify any of the member information; or
    • if does not meet our registration standards

17. Member obligations

a. You must be the author of your profile or have all the permissions you need to quote and use any information, graphics or photographs you have not written, created or taken. We have no liability if any profile breaks, limits or undermines a third party’s rights.

b. The terms of your order and your member information must always be complete, accurate, truthful and up to date.

c. You must tell us, as soon as possible, about any complaints made about your professional services, as this may affect your eligibility to be a member of Therapy Finders.

d. You must tell us, as soon as possible, about any matter which has affected or could affect your professional reputation (for example, professional sanctions, allegations, investigations and so on), as this may affect your eligibility to be a member of Therapy Finders.

e. You must co-operate with us in all matters relating to our services.

f. You must allow us and our employees to contact you at all reasonable times and keep the contact details we have for you up to date.

g. You must give us any information and materials we may reasonably need in order to provide our services, and make sure that the information is accurate.

h. You must always have all the licences and permissions you need in order for us to provide our services.

i. You must maintain any services or products we need to provide our services to you, such as email accounts, phone line and so on.

j. You must protect any sensitive information and materials associated with your account on our site, including (but not limited to) your username, password, log-in details, documents, policies, notices and correspondence, and make sure that these are not given to any unauthorised third parties.

k. Your profile must only specify issues, techniques or approaches you are qualified to offer or deal with.

l. Your profile must not:

    • use obscene or vulgar language or contain content that is intended to promote or incite violence;
    • contain content that is unlawful or otherwise offensive or upsetting (including information that may break any rule, regulation or law specific to your business or industry);
    • contain any content that is abusive, threatening, harassing, defamatory, ageist, sexist or racist;
    • break, limit or undermine the intellectual property rights of any third party; or
    • contain viruses or any other software or instructions that may damage or disrupt other software, hardware or communications network.
    • Your profile must be honest and fair, not make any claims that cannot be proved, not make dishonest or unreasonable comparisons with other businesses, be placed in the appropriate category and not impersonate other people or businesses.
    • If we cannot meet, or are delayed in meeting, any of our obligations under these terms and conditions as a result of anything you have or have not done, or your failure to meet an obligation, the following will apply.
    • We can suspend our services until you have put the matter right (if it can be put right), and not have to meet any of our obligations which have been prevented or delayed by something you have or haven’t done.
    • In the event that any of the provisions are not followed, or any other conditions are broken, we may remove your profile and suspend or end our services. In this case, you will not be entitled to any refund. We can also make any alterations to profiles if we consider it necessary to remove any material which might lead to legal action. In this case we will tell you about any alterations we have made. If we want to make changes to your profile for a reason other than the possibility of legal action, we will ask you for permission to make the change.
    • We will not be liable for any costs, damages or losses you suffer as a direct or indirect result of us failing to meet, or a delay in us meeting, any of our obligations as set out in this clause, or as a result of any mistakes in your listing.
    • If we ask in writing, you must reimburse any costs or losses we suffer as a direct or indirect result of something you did or failed to do.
    • You must have a professional idemnity insurance policy, which is vaild and in your name.  The insurance policy must cover the types of therapy you carry out with users from our website.

m. If you upload any images to our site you are agreeing and acknowledging that we can use these however we so wish within the company, for as long as we need.  This is also binding if you cancel your membership and subscription.

n. When you subscribe to our site you are confirming that you accept our member terms and conditions and agree to keep to them. This does not limit your obligation to keep to these terms of use or to any document referred to.

o.You agree and acknowledge that TherapyFinders Ltd can remove, amend, or complete your Therapist Profile. This also includes removing, amending, or completing parts or all of the written text within the profile. An example would be removing contact details from the therapist’s biography sections.

18. Your subscripton

a. Pre-launch Free Trials: When we offer pre-launch free trials for our Services, once a free trial expires, you will be contacted before your renewal takes place – there is no obligation to continue after the pre-launch free trial.

b. We offer different subscription options that you can choose; including billing that can occur monthly or annually. Any type of subscription you choose to subscribe to after your pre-launch free trial will continue and automatically renew until you cancel the membership. By choosing a recurring membership service, you acknowledge that such paid services have a recurring payment and you accept responsibility for all recurring charges prior to cancellation.

c. You can cancel the subscription to the service at any time for any reason. Your membership must be cancelled before it renews in order to avoid the next billing cycle.

d. If you decided to switch your subscription you will remain on your original plan until it ends, after which time the new subscription will take effect.  You will not be entitled to a refund as you will not move to your new plan until such time that your original plan ends.

e. If you decided to use the “Hide me from Therapist search results” facitily you will not be entitled to a refund for the duration that your profile remains hidden.  Your subscription will continue and payments will be taken as usual.

d. We reserve the right to change our subscription or adjust prices of our services. Any changes to your membership services will only take effect following proper notice to you.

e. In addition to s.18(d), we reserve the right to amend, revoke or apply discounts and free trial periods at any time we choose. Any changes to your membership services will only take effect following notice to you.

f. If you were eligible for our premium subscription for the price of standard offer, it is only valid for 12 months from when you subscribed to it. This offer cannot be paused or reactivated at any time. Once your offer has ended, it will automatically renew until you cancel the membership. By taking advantage of this offer, you acknowledge that such paid services have a recurring payment, and you accept responsibility for all recurring charges prior to cancellation.

g. In the event that we have to issue a refund, it may take up to 15 working days depending on the day of which it was requested.

19. Consent

a. You hereby confirm that you are legally able to consent to receive Services, or have the consent of a parent or guardian, and are legally able to enter into a contract.

b. Minor Consent: Where consent from a parent or guardian is required to receive Services, you hereby confirm that as the consenting parent or guardian, you have the sole right to consent to Services for the minor seeking therapy and are not legally mandated to confer with or get consent from any other legal guardian before consenting. You also give affirmative consent to the provisions set forth in the accompanying Privacy Policy regarding the collection, process, and use of personal information on behalf of the minor. You also agree that consent to Services remains valid until membership is cancelled.

c. You hereby confirm and agree that all the information that you provided in or through the site, and the information that you will provide in or through the site in the future, is accurate, true, current and complete. Furthermore, you agree that during the term of this Agreement you will make sure to maintain and update this information so it will continue to be accurate, current and complete.

20. Emotional First Aid Service

a. When using our Emotional First Aid Service as a Member or Client, you must not:

    • use obscene or vulgar language or show or discuss content that is intended to promote or incite violence;
    • show or discuss content that is unlawful or otherwise offensive or upsetting (including information that may break any rule, regulation or law specific to your business or industry);
    • be abusive, threatening, harassing, defamatory, ageist, sexist or racist
    • carry out indecent exposure, flashing or show inappropriate explicit content
    • break, limit or undermine the intellectual property rights of any third party; or
    • download viruses or any other software or instructions that may damage or disrupt other software, hardware or communications network.

b. As a member, if any of the terms stated in s.20(a) occur, we have the right at any time to terminate your membership and/or report the matter to the relevant law-enforcement authorities, giving them your name and contact details.

c. As a client, if any of the terms stated in s.20(a) occur, we have the right at any time to deny you use of our services on www.therapyfinders.co.uk and/or report the matter to the relevant law-enforcement authorities, giving them your name and contact details.

d. Both the client and member are responsible for any further contact/communication after the Emotional First Aid session has ended.

e. The member has the right to charge future therapy sessions at a different rate to what the client was charged using the Emotional First Aid service.

f. Our Emotional First Aid service is active between the hours of 8am and 10pm, seven days a week, however this may be subject to change.

g. As a member you agree to uphold the confidentiality boundary to the client unless you consider there to be serious harm to (the client) or someone else. If this occurs, please contact 07940390778 and we will contact the emergency services due to obtaining the client’s contact details.

h. We will not be liable if a client uses our Emotional First Aid service as a suicide line as it is clearly stated on our website that our services are not used for that purpose.

i. We do not guarantee that our Emotional First Aid service will always be available or will never be interrupted.

j. The client will not be eligible to receive a refund once a member is allocated through our Emotional First Aid service. This includes if you leave the session at any time.

k. All payments are made through our payment gateway, Stripe, if you have any questions/disputes, please email info@therapyfinders.co.uk and we will try help as much as possible however please note the dispute may need to be raised with Stripe, if we cannot solve the issue or the issue lies with them.

l. We will never record or store any Emotional First Aid sessions between members and clients.

m. By ticking the terms and conditions box on the Emotional First Aid register form, you agree and acknowledge that the terms stated in this document are binding on you.

21. Members Portal 

a. The information on our Members Portal can be updated, changed, or amended at any time by us only.

b. We will not be liable for any issues that arise with the companies who are advertised on our Continuing Professional Development page of the Members Portal. Members are obliged by our terms and conditions as well as the companies terms and conditions if they use their services.

c. We will not be liable for any injury that occurs from carrying out our self-care videos. The member is solely responsible.

d. The Members Portal is only available for Standard and Premium Member Subscriptions. However, this can be amended at anytime that we choose.

e. The terms stated in S.7 of this document (Property rights) are also upheld with regards to our Members Portal.

f. The terms stated in S.9(G) of this document (not responsible for the content of any other website/article) are also upheld with regards to links on our Members Portal.

 

22. Press Coverage Page

a. The information on our Press Coverage page can be updated, changed, or amended at any time by us only.

b. The terms stated in S.7 of this document (Property rights) are also upheld with regards to our Press Coverage Page.

c. The terms stated in S.9(G) of this document (not responsible for the content of any other website/article) are also upheld with regards to links on our Press Coverage Page.

23. Matching Service and Location Search

a. After the booking form notification has been sent to the member’s email address, the member is solely responsible for making contact with the user. Once contact has been made between the member and the user, the ‘user’ is now referred to as a ‘client’ when referring to terms in this document.

b. Both the client and member are responsible for attending the session and the transaction of monies between them. We will not be liable for the member or client not attending and/or any monies that are not transferred.

c. Our Matching Service and Location Search are free to use, with subject to change, however the client will be liable for paying the member their fee for the session that they attend.

d. Users must not use any of the members’ locations for any other means than to locate a member for a therapy session. If the user uses the member’s details for any other reason, we may report the matter to the relevant law-enforcement authorities and give them any information we hold about the individual.

e. As a user, by filling out the pop-up form on the Matching Service and Location Search, you agree that you give TherapyFinders Ltd permission to store your email address as well as use it to contact you in the future. We will not sell your information to any third-party or use it outside of TherapyFinders Ltd use.

f. By ticking the terms and conditions box on the Matching Service and Location Search, you agree to all the terms and conditions set out in this document.

24. Affiliate Scheme

a. TherapyFinders Ltd reserves the right to activate and deactivate the affiliate scheme at any time without prior notice.

b. You can only receive an affiliate code if you are a TherapyFinders Ltd member.

c. Affiliate codes are available on all subscriptions, but we reserve the right to amend this at any time we choose.

d. Each affiliate referral is worth £50. We reserve the right to change the price of this at any time without prior notice.

e. The affiliate scheme discount can only be redeemed on a Premium Annual subscription.

f. Paying members can use up to three affiliate referral discounts at one time after their current subscription expires.

g. Any remaining affiliate referral discounts that have not been applied that year, will be available for use in the following year under the same conditions as referred to in S.24(f).

h. If the member does not use the remaining affiliate referral discounts in the following year (stated in S.24(g), they will be automatically invalid and unredeemable.

i. You can only redeem an affiliate referral discount if the member you referred to TherapyFinders Ltd still has an active paying subscription.

j. Affiliate referral discounts have no monetary value and therefore cannot be used for any other reason than to receive a discounted subscription.

k. You must satisfy all the necessary terms stated in this document in order to take advantage of the affiliate scheme.

 

25. Definitions

a. ‘Our’ in this document refers to belonging to TherapyFinders Ltd as well as operated by TherapyFinders Ltd.

b. ‘Us’ in this document refers to TherapyFinders Ltd.

c. ‘We’ in this document refers to TherapyFinders Ltd.

d. ‘Third Parties’ in this document refers to a company, individual or entity not relating to TherapyFinders Ltd.

e. ‘User’ in this document refers to any person, individual or entity who accesses therapyfinders.co.uk

f. ‘Client’ in this document refers to any person, individual or entity who contacts a therapist for a therapy session through any of TherapyFinders Ltd services.

g. ‘Members’ in this document refers to any person, individual or entity who has signed up as a qualified therapist to TherapyFinders Ltd. The member’s subscription status does not matter in this instance.

h. ‘Our site’ in this document refers to therapyfinders.co.uk

i. ‘Website’ in this document refers to therapyfinders.co.uk

j. ‘Affiliate referral’ in this document refers to an individual person who has been referred to TherapyFinders Ltd by a different TherapyFinders member.

k. ‘Affiliate referral discount’ in this document refers to a £50 deduction.

l. ‘Affiliate Code’ in this document refers to the code that a TherapyFinders Ltd member receives when they register at therapyfinders.co.uk. Each code is unique for each member.

26. Governing law

a. These terms of use, their subject matter and their formation, are governed by English law. You agree that any legal dispute between you and us will only be settled in the courts of England.

Acceptable use policy

This acceptable use policy sets out how you may use our website at www.therapyfinders.co.uk (our site). It applies to everyone who visits or uses our site, including members (Counsellors and Therapists registered on our site).

By using our site you accept, and agree to keep to, this acceptable use policy, which applies alongside our website terms of use.

Prohibited uses
You must not use our site in the following ways.

    • In any way that breaks any relevant local, national or international law or regulation that applies.
    • In any way that is (or is intended to be) unlawful or fraudulent or has any unlawful or fraudulent effect.
    • In any way that harms, or could harm, minors (people under 18).
    • To send, knowingly receive, upload, download, use or reuse any material which does not meet our content standards.
    • To send, or help in sending, any unsolicited or unauthorised advertising or promotional material (spam).
    • To knowingly send or upload any data or material that contains viruses, Trojans, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or computer code designed to damage the usability or functions of any computer software or hardware.

Also, you must not do the following.

    • Reproduce, copy or resell any part of our site, if this does not keep to our website terms of use.
    • Interfere with, damage or disrupt:

      o any part of our site;
      o any equipment or network our site is stored on;
      o any software used to provide our site; or
      o any equipment, network or software owned or used by any third party;
      unless you have all the permission you need.

Content standards

These content standards apply to any material you contribute to our site (contributions), and to any interactive services associated with it. You must meet the following standards. The standards apply to all of, and each part of, any contribution.

Contributions must:

    • be accurate (where they state facts);
    • be genuinely held (where they state opinions); and
    • keep to all relevant laws that apply in the UK and in any country the contribution was created in.

Contributions must not do the following

    • Contain any material which is obscene, offensive, hateful or inflammatory.
    • Promote sexually explicit material.
    • Promote violence.
    • Promote discrimination based on race, sex or gender, religion, nationality, disability, sexuality or age.
    • Break, limit or undermine any other person’s copyright, database right or trademark.
    • Be likely to deceive any person.
    • Fail to meet any legal duty you owe to a third party, such as a duty under a contract or an obligation to keep anything confidential.
    • Promote any illegal activity.
    • Be threatening or abusive, invade another’s privacy, annoy or inconvenience anyone, or cause needless anxiety.
    • Be likely to harass, upset, embarrass, alarm or annoy any other person.
    • Be used to impersonate any person, misrepresent your identity or misrepresent an association with any person.
    • Give the impression that they come from us, if this is not the case.
    • Support, promote or help with any unlawful act, such as computer misuse or breaking, limiting or undermining a copyright.
    • Contain any material which damages a person’s reputation.
Suspension and termination

If we decide that your use of our site does not keep to this acceptable use policy, we may take whatever action we consider appropriate.

If you do not keep to this acceptable use policy, you will have broken our website terms of use, which may result in us doing any or all of the following.

    • Temporarily or permanently withdrawing your right to use our site, without giving you notice.
    • Temporarily or permanently removing any material or contribution you have posted or uploaded to our site, without giving you notice.
    • Give you a warning.
    • Recover all our costs (including, but not limited to, reasonable administrative and legal costs) that have arisen as a result of you breaking the website terms of use.
    • Take legal action against you.
    • Give law-enforcement authorities any information they reasonably need.
